Summary judgment. This action was begun of the 1st day of April, 1946, by the plaintiff, Lee A. Strauss, a beer salesman, against Eulberg Brewing Company, defendant, to recover damages for breach of an agreement to pay the plaintiff commissions at the rate of 5â€º per case of beer and ale sold by him and to deliver on orders obtained by the plaintiff during the year 1946, 200,000 cases of beer. In his amended complaint, the plaintiff alleged: That between December 1st, 1945, and January 31, 1946, the plaintiff and defendant entered into an express agreement, which was in large part reduced to writing by correspondence, whereby for and in consideration of the plaintiff selling the defendants products, the defendant agreed to pay the plaintiff commissions at the rate of five cents (5c) per case of beer and ale sold by him. That the defendant by said written agreement contracted with the plaintiff to furnish for sale through the plaintiff One Hundred carload of Two Hundred Thousand cases of beer and ale, to be delivered on orders to be obtained by the plaintiff during December, 1945, and throughout the year 1946.
